The Allegation

The client was charged with uttering threats and assault following an incident involving several individuals while carrying out work-related responsibilities. The prosecution alleged that the client had threatened and assaulted those individuals during the incident.

Defence Advocacy

Those submissions addressed the conduct of the individuals involved, the client’s responsibilities at the time, and the broader context of the incident. Information concerning the involvement of other workers was also provided as part of the overall assessment of the matter.

After considering the defence submissions and the circumstances of the incident, Crown counsel agreed not to proceed with the prosecution.
