Sexual Assault Charge Acquittal After Contested Trial

The Allegation

The client was charged with sexual assault arising from allegations made by an individual with whom the client had interacted in a professional setting. The complainant alleged that inappropriate conduct occurred on more than one occasion over a period of time. The matter proceeded to a fully contested trial, where credibility and the reliability of the evidence were central issues.

Although the Court did not accept all aspects of the client’s evidence, the defence successfully demonstrated that the prosecution had not proven the charge beyond a reasonable doubt.

The Result

The Court was not satisfied that the complainant’s evidence established the charge beyond a reasonable doubt. The client was found not guilty and acquitted of the sexual assault charge.
